I defaulted on an MCA years ago, later paid it, and have a zero-balance letter plus a UCC release letter. The problem is the attorney never filed a satisfaction of judgment with the court, and the old judgment is now causing problems when I try to move forward. What proof do I need, and who is responsible for getting the judgment marked satisfied?
A zero-balance letter and UCC release help, but they are not the same as a filed satisfaction of judgment. Pull the court docket and confirm exactly what is still showing. Then contact the judgment creditor, attorney of record, and court clerk with the payoff proof and request a satisfaction or release filing. If they will not respond, a local attorney may be able to file a motion asking the court to mark the judgment satisfied based on your evidence. Also make sure any UCC-3 termination was actually filed, not just promised.
